Overview
The document is a brief overview of countries’ experiences in using the safeguards available in the TRIPS Agreement to protect public health and access to medicines. It is written in response to requests to share such experiences. Part I of this note highlights examples of compulsory licensing and application of strict patentability criteria. Part
II highlights examples of the use of competition law and TRIPS safeguards specific to least developed countries (LDCs).
